Welcome to OZELI.

These Terms of Service ("Terms") govern your access to and use of the OZELI website, as well as purchases made through our online store.

Throughout these Terms, "OZELI", "we", "us" and "our" refer to the operator of the OZELI online store. "You", "your" and "customer" refer to any person accessing our website or purchasing products from us.

By accessing our website, placing an order or using our services, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any consumer right or legal remedy that cannot lawfully be excluded under applicable law.

 Eligibility

By placing an order with OZELI, you confirm that you have the legal capacity to enter into a binding contract under the laws applicable to you.

If you are under the legal age required to enter into contracts in your jurisdiction, you may only use our store with the involvement of a parent or legal guardian where permitted by law.

Products

We aim to display our products and their characteristics as accurately as reasonably possible.

However, because products are viewed through different devices and displays, we cannot guarantee that colours displayed on your screen will perfectly represent the physical product.

Certain products may also contain natural materials such as wood, stone or other materials with naturally occurring variations. Differences in grain, texture, shade, pattern and similar characteristics may therefore occur between individual products.

Such natural variations are not necessarily defects.

This does not affect your rights where a product is materially different from its description, defective or otherwise does not conform to your contract under applicable consumer law.

 Product Images

Product images are intended to provide an accurate representation of the products offered.

Some photographs may include decorative props, furniture, plants, books or other objects for styling purposes. Unless specifically stated in the product description, these additional objects are not included with the purchased product.

Please review the product description carefully to determine exactly what is included.

Lifestyle photography, digital staging or edited imagery may be used to demonstrate how products can appear in a home environment. Such imagery will not change the material characteristics of the product described on the relevant product page.

Product Measurements

Product dimensions and measurements are provided on the relevant product page where applicable.

Small variations may occur due to manufacturing processes, measurement methods or natural materials.

Customers are responsible for reviewing product measurements before ordering.

A customer's failure to check clearly disclosed measurements does not automatically make a correctly supplied product defective.

Nothing in this section limits statutory rights where dimensions supplied by OZELI were materially inaccurate or misleading.

Prices

Prices are displayed in the currency shown on our website.

We reserve the right to change product prices at any time. Price changes will not normally affect orders that have already been accepted.

Prices displayed at checkout will apply to your order, subject to correction of genuine and obvious pricing errors where permitted by applicable law.

Any applicable taxes, shipping charges or other charges will be displayed or calculated as required before you complete your purchase.

Currency Conversion

Where our website displays prices in multiple currencies, converted prices may be calculated using currency conversion services or payment-provider exchange rates.

Your bank, credit-card company or payment provider may apply its own exchange rate or foreign transaction fees.

OZELI does not control fees independently imposed by your financial institution.

 Orders

Submitting an order does not necessarily mean that OZELI has accepted it.

After you place an order, you may receive an automated confirmation acknowledging that we received your order.

Where permitted by applicable law, we may reject or cancel an order before fulfilment for legitimate reasons including:

• Product unavailability;
• An obvious pricing or listing error;
• Payment authorization failure;
• Suspected fraud;
• Incorrect delivery information;
• Legal or regulatory restrictions;
• Inability to deliver to the supplied address; or
• Unusually large quantities suggesting unauthorized commercial resale.

Where we cancel an order after payment has been collected, amounts paid for the cancelled portion will be refunded.

We will not cancel orders for discriminatory or otherwise unlawful reasons.

 Payment

You agree to provide current, complete and accurate payment and billing information.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Payments may be processed by third-party payment providers. Their own terms and privacy practices may also apply.

We do not guarantee that every payment method will be available in every country.

Fraud Prevention

To protect our customers and business, orders may be subject to reasonable fraud-prevention checks.

We may request additional information where reasonably necessary to verify an order, payment or identity.

We reserve the right to cancel or hold an order where there is reasonable evidence of payment fraud, unauthorized payment use, identity theft or other fraudulent activity.

Nothing in this section permits us to unlawfully discriminate against customers or arbitrarily withhold legitimate orders.

 Shipping

OZELI ships to supported destinations worldwide.

Available shipping methods, estimated delivery times and shipping charges may vary according to destination and product.

Estimated delivery dates are estimates rather than guaranteed delivery dates unless we expressly state otherwise or applicable law requires delivery within a particular period.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier disruptions, customs processing, severe weather, strikes or other transportation disruptions.

Nothing in this section limits any statutory right you may have regarding delivery times.

International Orders, Customs & Import Charges

International shipments may be subject to customs duties, import taxes, VAT, brokerage charges or other governmental charges.

Where these charges are not collected by OZELI during checkout, they may be charged separately by the relevant authorities or carrier.

Where permitted by applicable law, the customer is responsible for such charges.

We recommend reviewing your country's import requirements before ordering.

We will not intentionally misdeclare the value, contents or nature of a shipment to reduce customs charges.

Nothing in this section transfers a tax or customs obligation to a consumer where applicable law requires OZELI to bear or disclose that obligation.

Delivery Information

Customers are responsible for providing complete and accurate delivery information.

Please check your:

• Street address;
• Apartment or unit number;
• Postal code;
• City;
• Country; and
• Other requested delivery information

before completing your order.

If you notice an error after ordering, contact us as soon as possible.

We cannot guarantee that an address can be changed after an order has entered processing or fulfilment.

Failed Deliveries

Where permitted by applicable law, customers may be responsible for reasonable additional costs resulting from an incorrect address, refusal to accept a valid delivery, or failure to collect a package.

This does not apply where the delivery failure was caused by OZELI, our fulfilment partners or another party for whom applicable law makes OZELI responsible.

 Risk During Delivery

Responsibility for loss or damage during shipping will be determined according to applicable law.

Nothing in these Terms is intended to transfer shipping risk to a consumer earlier than permitted by mandatory consumer protection law.

If your order arrives damaged or does not arrive, please contact us so that we can investigate the shipment.

Returns & Refunds

Returns, refunds, damaged products and related claims are governed by our Returns & Refunds Policy, which forms part of these Terms.

OZELI currently offers eligible customers a voluntary 30-day return period beginning when the order is received, subject to the conditions contained in that policy.

This voluntary policy does not replace mandatory cancellation, withdrawal, warranty, guarantee or other consumer rights available under applicable law.

Defective or Damaged Products

If a product arrives damaged, defective, incorrect or otherwise does not conform to the sales contract, please contact us.

Depending on applicable law and the circumstances, you may be entitled to a repair, replacement, price reduction, refund or another remedy.

Damage caused by misuse, accidents, improper installation, unauthorized modifications or other customer-caused damage after delivery is generally not considered a manufacturing defect.

This does not affect rights that cannot legally be excluded.

 Order Cancellations

If you wish to cancel an order, please contact us as quickly as possible.

We will attempt to cancel orders that have not entered fulfilment, but we cannot guarantee that cancellation will be possible once processing or shipping has begun.

Any statutory cancellation or withdrawal rights applicable to your purchase remain unaffected.

Promotions & Discount Codes

Promotional offers and discount codes may be subject to additional conditions communicated with the promotion.

Unless otherwise stated:

• Discount codes cannot be exchanged for cash;
• Only one promotional code may be used per order;
• Promotions cannot normally be applied retrospectively;
• Promotions may have expiration dates; and
• Promotions may be restricted to particular products, customers or regions.

We may cancel a promotional discount obtained through fraud, technical manipulation or clear abuse, where permitted by law.

Reviews & Customer Content

If you submit a genuine product review, photograph, comment or other content to OZELI, you remain responsible for the content you submit.

You must not knowingly submit:

• Fake reviews;
• Reviews relating to products you have not genuinely experienced;
• Defamatory or unlawful content;
• Fraudulent information;
• Malicious software;
• Content infringing another person's intellectual property rights; or
• Content impersonating another person.

Where permitted by law, we may moderate or remove content that violates these requirements.

We will not intentionally misrepresent fabricated testimonials or reviews as genuine independent customer experiences.

Intellectual Property

Unless otherwise stated, the OZELI name, branding, website design, written content, graphics, logos and other original materials owned by OZELI are protected by applicable intellectual property laws.

You may use our website for personal, non-commercial shopping purposes.

You may not, without permission:

In particular, nothing in these Terms excludes mandatory liability or consumer remedies that cannot legally be excluded.

To the maximum extent permitted by applicable law, OZELI will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into.

Nothing in this section limits liability for matters that applicable law prohibits us from excluding or limiting.

 Indemnification

To the extent permitted by applicable law, you may be responsible for losses reasonably suffered by OZELI as a direct result of your unlawful use of our website, fraud, intentional violation of these Terms or infringement of another person's rights.

This provision does not make consumers responsible for losses caused by OZELI or remove mandatory consumer protections.

Our collection and processing of personal information is described in our Privacy Policy.

By using our website, you acknowledge that personal information may be processed as described in that policy and in accordance with applicable data-protection law.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices or legal requirements.

The version displayed on our website will state when it was last updated.

Changes will not retroactively remove rights that have already arisen under an existing purchase where doing so would be prohibited by applicable law.

Severability

If any provision of these Terms is determined to be invalid, illegal or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be interpreted or limited only to the extent necessary to comply with applicable law.

Governing Law & International Consumers

These Terms and OZELI's operations are governed by the laws applicable to the business entity operating OZELI, subject to mandatory consumer protection rules.

If OZELI is operated by a business established in Switzerland, these Terms may generally be governed by Swiss law.

However, because OZELI sells internationally, customers in other countries may benefit from mandatory consumer protection laws that cannot legally be waived by choosing Swiss law.

Nothing in these Terms is intended to deprive a consumer of mandatory protections available to them under applicable law.

Where a provision of these Terms conflicts with mandatory consumer law applicable to your purchase, that mandatory law will prevail to the extent of the conflict.

EU & EEA Customers

Where European Union or European Economic Area consumer law applies, nothing in these Terms limits applicable statutory rights concerning matters including:

• Distance-contract withdrawal rights;

• Refunds;

 United Kingdom Customers

These Terms, together with our:

• Privacy Policy;
• Shipping Policy; and
• Any other policies expressly incorporated into these Terms

form the terms governing your use of our store and purchases, subject always to mandatory applicable law.
